this was the easy part, we already sent the IR output to the right default pin so all we have to do is SSH in

PW: openelec

nano /storage/.config/autostart.sh

add this

modprobe lirc_rpi

and save ctrl+x, then pick yes

reboot, then pick a remote you want to learn, and make a file for it
